1. Consent and Agreement
By accessing, using, or registering for services on LendLay’s website or related applications (the “Platform”), you consent to the collection, storage, and processing of your personal and financial information in accordance with these Terms and LendLay’s Privacy Policy.
Your use of the Platform confirms that you have read, understood, and agreed to these Terms. Continued use of the Platform constitutes ongoing acceptance of updated Terms.
2. Eligibility
- You must be 18 years or older to register and use LendLay services.
- You must provide accurate and complete personal, employment, income, and banking information.
- Documents required for registration:
- Full Name and Surname
- South African ID Number
- Photo of ID
- Selfie Of Applicant
- Proof of income, employment, or institution enrollment
- Last 3 months of bank statements
- Delivery address & home address
- Alternative contact name and number
- Each customer must register their own account. Accounts are personal and non-transferable.
3. Device Financing Contracts
- Application: A first instalment of the device is required upon application.
- Application Does not mean Approval
- If Customer is declined a full refund will be made (Refund will be processed in 7 - 10 Business Days)
- Instalments: Remaining payments depend on the device price and chosen instalment plan (3, 6, 9, 12 months).
- Payment Methods: Payments must be made via the methods provided on the Platform.
3.1 Late Payments and Penalties
- Payment reminders will be sent if an instalment is missed or late.
- Devices are equipped with LendLay software that can lock the device if payments are not made as scheduled.
- Late fees and/or penalties may apply as outlined during the contract setup. Customers are made aware of these charges at the time of approval.
3.2 Device Handling
- Devices are brand-new and only opened at LendLay offices prior to delivery to install the locking software.
- Tampering with the device or software may result in immediate action by LendLay, including device locking.
3.3 SIM Plan Included with Device
- The device contract includes a SIM plan. Customers may migrate their plan to a higher package or drop to the standard free plan included with the device.
- Customers cannot downgrade below the standard free plan.
- The standard plan is linked to the device financing contract and cannot be cancelled independently; cancelling the SIM plan alone is only available under SIM-only plans.
4. SIM-only Plans
- Customers may cancel SIM-only plans with 30 days’ notice.
5. Personal Information & Privacy
- LendLay collects and stores personal, financial, and contact information for verification and service provision.
- Consent to receive marketing communications is requested during registration.
- All data is processed in compliance with South African law and LendLay’s Privacy Policy.
6. Intellectual Property
- All content, software, graphics, logos, and materials on the Platform are the property of LendLay.
- Unauthorized use, copying, redistribution, or commercial exploitation of content or software is strictly prohibited.
7. Customer Responsibilities
- Maintain confidentiality of account credentials.
- Notify LendLay immediately if unauthorized access occurs.
- Customers indemnify LendLay against any loss or liability resulting from misuse of their account, device, or services.
8. Use of the Platform
- Customers may not use the Platform for fraudulent, unlawful, or harmful purposes.
- Prohibited activities include, but are not limited to:
- Impersonating another person
- Collecting personal data of other users
- Uploading malicious software or viruses
- Circumventing device security or LendLay software
- Any form of financial fraud or pyramid/Ponzi schemes
9. Accuracy of Content
- LendLay takes reasonable steps to ensure the accuracy of all content on the Platform.
- However, LendLay does not guarantee content accuracy, completeness, or fitness for any purpose.
- LendLay reserves the right to modify or withdraw services at any time without prior notice.
10. Warranties and Liability
- Use of the Platform, devices, and services is at the customer’s own risk.
- LendLay disclaims all warranties, express or implied, including merchantability or fitness for a particular purpose.
- LendLay, its directors, employees, or affiliates will not be liable for indirect, incidental, or consequential damages.
11. Indemnity
- Customers agree to indemnify LendLay, its officers, directors, employees, and affiliates from any loss, claims, or costs arising from:
- Breach of these Terms
- Misuse of devices or software
- Fraudulent or unlawful activity
12. Customer Complaints and Refunds
- Customers may submit complaints via support@lendlay.com or the Platform’s support portal.
- Refunds for device financing are only considered if:
- The device is defective upon delivery (brand-new and unopened devices).
- Proof of defect is provided within 7 days of delivery.
- Refunds may include replacement, repair, or partial refund depending on the situation.
13. Dispute Resolution
- These Terms are governed by the laws of the Republic of South Africa.
- Jurisdiction for any dispute arising under these Terms lies with the High Court of South Africa.
14. Modifications
- LendLay reserves the right to update or amend these Terms at any time.
- Continued use of services constitutes acceptance of updated Terms.
15. Force Majeure
- LendLay is not liable for failure to perform obligations due to events outside its control, including natural disasters, strikes, power failures, or government restrictions.
