Aweh Promo Unlimited Voice & Text Plans – Terms and Conditions

By purchasing a LendLay Aweh Promo Unlimited Voice & Text Plan, all participants are and agree to be bound by these Terms and Conditions and to be subject to the Fair Use Policy.

These Plans are strictly for the personal and private usage of natural persons and may not be used for business or commercial use in any form.

Each LendLay Aweh Promo Plan offers Unlimited voice and SMS services, and capped Data, subject to our Fair Use Policy, as follows:

** Unlimited means that the service is unlimited, but is subject to these Terms and Conditions, is to use within LendLay’s Fair Use Policy:

General

1. The Aweh Promo Unlimited Voice & Text Plans will launch on 28 July 2025 (“start date”).
2. LendLay reserves the right to change the plan, or to terminate the Plans at any time, based on reasonable prior notice.
3. LendLay reserves the right to change or amend these terms and conditions at any time, provided that, where a change is material, it will be subject to reasonable prior written notice published on its website.
4. LendLay reserves the right to limit the Service in areas where there is limited network capacity (high congestion) in order to maintain consistent quality of services.
5. LendLay reserves the right to alter or terminate the Service in order to prevent a catastrophic impact on the network.

Eligibility

6. The Aweh Promo Unlimited Voice & Text Plans are available only to natural persons who have a LendLay (Melon) SIM and are for use in a mobile phone only.
7. The Aweh Promo Unlimited Voice & Text Plans are strictly reserved for the private and personal use of natural persons and are not available, and may not be used, for business or commercial use, in whatever form.
8. Where usage exceeds the Fair Use Policy terms as set out above, LendLay reserves the right to examine the usage of the Services, in order to establish whether, on an analysis of the usage patterns of the unlimited Services, there is a reasonable basis to determine that the Services are not being used for the personal and private usage of a natural person, and are being used primarily for business and/or commercial purposes.
9. Where, in the reasonable determination of LendLay as set out in paragraph 8 above, it is found that the consumer is not complying with these Terms and Conditions, and is reasonably determined not to be using the Services primarily for personal and private usage, LendLay shall have the right to engage with the consumer directly in order to (a) migrate them onto an alternative package that accords with their usage requirements, and/or (b) to immediately disconnect, or (c) suspend the Services linked to a SIM of any ineligible customer or where the Services are suspected of being used for an excluded application or purpose or in breach of these Terms and Conditions and/or the express Fair Use Policy set out above.

Participation

10. Any natural person may elect to purchase an Aweh Promo Unlimited Voice & Text Plan at any time during the promotion period.
11. By their participation, every participant agrees to be bound to these terms and conditions and acknowledges and accepts the terms of the Fair Use Policy.
12. In order to participate, you will need to:
    1. Visit Lendlay.com and Apply on the website;
    2. New customers: complete the on-boarding journey to become a LendLay customer, and then go to Aweh Promo Unlimited Voice & Text Plans;
    3. Existing customers: go to upgrade monthly plan, then go to Aweh Promo Unlimited Voice & Text Plans;
    4. Select your preferred Aweh Promo Unlimited Voice & Text Plan, click continue and order the plan;
    5. Once payment is successful, your Plan will be updated to an Unlimited Voice & Text Plan.
13. The participant will only need to sign in once, and accept these terms and conditions, as they may be amended, in order to participate in and enjoy the benefits of the Aweh Promo Unlimited Voice & Text Plans.

Other Terms and Conditions

14. All of these terms and conditions in respect of the Aweh Promo Unlimited Voice & Text Plans must be read in conjunction with LendLay’s Standard Terms and Conditions, Terms of Use and Privacy Policy, which applies to all LendLay Customers, and which is freely available on the LendLay’s website at https://lendlay.com
15. The participant must be registered and signed-up with LendLay and be in possession of a LendLay (Melon) SIM, and follow the process set out above in order to participate in the Melon Unlimited Voice & Text Plans.
16. The unlimited voice and unlimited SMS services are not transferable and may only be utilized by the LendLay (Melon) SIM card associated with the Services, used in a mobile phone by a natural person.
17. The participant may terminate or cancel the Services at any time, but shall not be entitled to a refund from LendLay in respect of any unused services for the remainder of the period, or in respect of any estimated usage of the services.
18. In the event that LendLay terminates the Services due to a breach of these terms and conditions, the participant shall not be entitled to any refund.
19. LendLay does not accept any liability or responsibility in respect of any misapplication of the promotion, whether by the Customer or any other third party, or any errors that lie beyond their control;
20. These terms and conditions shall be governed by and construed in accordance with the laws of South Africa.
